Terms of Service

These terms apply to this website, the waitlist, and any course, video, workbook, calculator, tool, or learning community offered by Fire Forged Enterprise LLC, a Nebraska limited liability company ("Fire Forged," "we," "us"). Together these are called the "Course." By joining the waitlist, buying a seat, or using the Course, you agree to these terms. If you buy on behalf of a company, you confirm you have authority to bind that company, and "Customer" means that company.

1. The waitlist

Joining the waitlist is free and does not obligate you to buy anything. Founding pricing, if offered, is at our discretion and may be limited in time or number of seats. Prices and course content may change before enrollment.

2. Per-seat license

The Course is licensed per seat. One seat is for one named person.

  • What a seat is. Each seat purchased grants a limited, non-exclusive, non-transferable license for one named individual (a "Learner") to access the Course for internal training. A seat is not a company account, a shared account, or a department account.
  • No sharing. Login credentials may be used only by the Learner they were issued to. Customer and each Learner may not share, lend, or disclose logins, and may not show, stream, screen-share, download, record, copy, or distribute Course content to anyone who does not hold their own seat. Group viewing is allowed only under a facilitated license that lists every participant as a Learner.
  • Customer is responsible. Customer is responsible for every seat it buys and for the compliance of its employees, contractors, and Learners with these terms.
  • Liability for unauthorized use. If a login is used by anyone other than its Learner, or Course content is provided to anyone who does not hold a seat, Customer agrees to pay Fire Forged, for each unauthorized person, the full then-current list price of one seat, without any discount, promotional, or founding pricing, plus our reasonable costs of collection, including attorney's fees. Customer and Fire Forged agree that the revenue lost from unauthorized use is difficult to calculate, and that this amount is a reasonable estimate of that loss and not a penalty. This does not limit any other remedy available to us, including injunctive relief for misuse of our intellectual property.
  • Enforcement. We may monitor login activity, including concurrent sessions, devices, and approximate location, to enforce this license. We may suspend or terminate any login involved in unauthorized use, without refund.
  • Reassigning a seat. If a Learner leaves Customer's employment, Customer may ask us in writing to reassign that seat to a replacement Learner one time. Course progress does not transfer.

3. Our content

All Course content, including videos, slides, workbooks, calculators, frameworks, and examples, is owned by Fire Forged and protected by copyright and other laws. You may not resell, sublicense, adapt, or use Course content to create your own training materials. Learners may keep the workbook pages they complete for their own use.

4. Learning community

Enrolled Learners may be invited to an optional online learning community. Be respectful, keep it on topic, and do not post your employer's confidential information, including financial statements, customer names, or pricing. We may remove posts or members at our discretion. Community access ends when the related seat ends.

5. Payment and refunds

Payment is due at enrollment or on the terms stated on your invoice. Unless your order or invoice states otherwise, you may request a full refund within 14 days of purchase for any seat whose Learner has completed no more than one lesson. Seats terminated for unauthorized use are not refundable.

6. Educational purpose

The Course is educational. Example numbers, including yield, downtime, labor, and turnover figures, are illustrations and may not match your plant. Nothing in the Course is financial, accounting, legal, or engineering advice, and we do not guarantee any particular result.

7. Limitation of liability

To the fullest extent the law allows, the Course is provided "as is," and Fire Forged's total liability for any claim related to the Course is limited to the amount Customer paid us for the Course in the 12 months before the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or production losses.

8. Governing law

These terms are governed by the laws of the State of Nebraska. Any dispute will be brought in the state or federal courts located in Lancaster County, Nebraska, and both parties consent to that venue.

9. Changes

We may update these terms. The effective date above shows the latest version. Changes do not apply to seats already purchased unless the Customer agrees.
